A conservatorship is the court-supervised process of appointing a person (the conservator) to manage the affairs of an individual who, due to physical and/or mental incapacity, is unable to do so for him or herself (the conservatee). In many cases, conservatorships involve elderly people with dementia (sometimes caused by Alzheimer’s Disease). If such an individual has not executed a durable power of attorney and/or advance health care directive appointing someone else to manage his or her financial affairs and make medical decisions for him or her, a conservatorship may be necessary. Generally, it is preferable to avoid a conservatorship by having a valid durable power of attorney and advance health care directive in place.
